Terms of Service

These Terms of Service ("Terms") govern your use of the Nightstand mobile application and this website ("the Service"), provided by Geoffrey A., an individual developer based in Jamaica ("we", "us", "I"). By using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use the Service. By accessing the Service you represent that you meet this requirement. The Service is not directed to individuals under 18.
2. License
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Nightstand app on devices you own or control, solely for your personal, non-commercial use, subject to these Terms and the Google Play Terms of Service.
3. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or modify the app except as permitted by law;
- Use the Service to harass, threaten, or harm another person;
- Attempt to bypass security controls including the age gate and app lock;
- Resell, sublicense, or redistribute the Service.
4. Premium features and purchases
The core Service is free to use. Optional Nightstand Premium features are unlocked through in-app purchases processed by Google Play and governed by Google's payment terms. Premium is offered on three plans: a monthly auto-renewing subscription, a yearly auto-renewing subscription, and a one-time lifetime purchase. Current prices are shown in the app at the point of purchase.
Auto-renewal. Monthly and yearly plans automatically renew at the end of each billing period at the then-current price, using the payment method on file with Google Play, until you cancel. You can cancel at any time from your Google Play account (Google Play → Payments & subscriptions → Subscriptions). Cancellation takes effect at the end of the current paid period; you keep Premium access until then. Uninstalling the app does not cancel a subscription.
Lifetime. The lifetime purchase is a single, non-recurring payment that unlocks Premium features on your Google account for as long as the app continues to be distributed. It is not a subscription.
Refunds. Refund requests must be made through Google Play in accordance with Google's refund policy. We do not issue refunds directly. Statutory cancellation and refund rights you have under the consumer laws of your jurisdiction are not affected.
5. Your data
Nightstand stores your content locally on your device. You are responsible for backing up your data (the in-app Export to CSV feature is provided for this purpose). We cannot recover data lost due to device failure, uninstallation, reset, or deletion.
6. Intellectual property
The Nightstand name, logo, design, and source code are owned by Geoffrey A. and are protected by applicable intellectual-property laws. Content you enter into the app (toy names, notes, photos) remains yours.
7. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or free from data loss.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR USD $20 IF YOU MADE NO PAYMENT.
9. Termination
You may stop using the Service at any time by uninstalling the app. We may suspend or terminate your access if you materially violate these Terms.
10. Changes
We may modify these Terms from time to time. The "Last updated" date will reflect the most recent revision. Continued use of the Service after changes constitutes acceptance.
11. Governing law
These Terms are governed by the laws of Jamaica, without regard to conflict-of-laws principles. The courts of Jamaica shall have non-exclusive jurisdiction over any disputes arising from or relating to these Terms. This does not override mandatory consumer-protection rights available to you under the laws of your country of residence.
